Mr. Monahan has practiced continuously in Montgomery County, Maryland since 1977, now 38 years and counting. His practice has focused on representation of people charged with driving under the influence offenses and other serious traffic offenses, criminal defenses, and the representation of victims injured in auto accidents due to another person’s negligence.
Mr. Monahan is a past President of the Bar Association of Montgomery County (2006 - 2007) and President of the Bar Foundation of Montgomery County, Maryland (2006 - 2008) and still remains a Board Member of the Bar Foundation. He is a member of the Board of the Maryland Criminal Defense Attorneys Association and also is an ex-officio Bencher of the Montgomery County Inn of Court.
He has been chosen as a Super Lawyer in the area of civil auto accident representation by Super Lawyers 2007-2013 and 2015. Only the top 5% of attorney in the State of Maryland are named in Super Lawyers.
Since 1992, Mr. Monahan has tried to verdict as sole counsel approximately 450 cases in the District and Circuit Courts of Maryland. He regularly appears at the Motor Vehicle Administration and has also been chosen as Mediator and Arbitrator in the resolution of civil cases and is currently a Disability Arbitrator in the Montgomery County Government Retirement system.
In Maryland, people charged with Driving Under the Influence, Driving Under the Influence Per Se, or Driving While Impaired, actually have two proceedings to deal with. The Administrative proceeding dealing with potential license suspension is at the Motor Vehicle Administration and before the Office of Administrative Hearings. The Court case which deals with consequences such as jail, probation, and fines, is totally separate.
